What is the Madrid Protocol?
The Madrid Protocol is an international treaty administered by WIPO that allows trademark owners to seek protection in multiple countries through a single application.
Do I need a registered trademark in India first?
You need either a registered trademark or a pending application in India. The international application is linked to your Indian base mark for the first 5 years.
How long does international registration take?
WIPO typically registers the mark within 2–3 months. Each designated country then has 12–18 months to raise objections under its local law.
What happens if my base mark is cancelled within 5 years?
If the Indian base mark is cancelled within 5 years of the international registration date, the international registration may be affected. After 5 years, it becomes independent.
